Welcome to Dermicea. These Terms & Conditions govern your access to and use of the Dermicea Dermatology Clinic Management Software, EMR platform, and associated services (collectively, the "Service"), provided by Woltbot.

By setting up an account or using the Service, you agree to be bound by these Terms. If you are entering into this agreement on behalf of a clinic, hospital, or other legal entity, you warrant that you have the authority to bind such entity to these Terms.

1. License & Scope of Service

Dermicea grants you a non-exclusive, non-transferable, revocable license to access and use our software on a subscription basis, strictly for the internal administrative and clinical operations of your dermatology practice.

You may not reverse-engineer, resell, or distribute our software, code, templates, or branding materials to any third party.

2. User Account Responsibilities

Authorized Personnel: Only licensed medical practitioners and their authorized clinic staff are permitted to write prescriptions, record clinical diagnoses, or log medical charting in Dermicea.
Account Security: You are responsible for keeping your login credentials confidential. Any activity taking place under your clinic account is your sole responsibility.

3. Patient Consent & Legal Compliance

Dermicea is a digital custodian. Under the Digital Personal Data Protection Act (DPDP Act) and medical guidelines in India, you (the clinic/doctor) are solely responsible for:

Obtaining explicit consent from patients before uploading their personal details, contact numbers, clinical photographs, and medical histories to the Service.
Ensuring compliance with the Telemedicine Practice Guidelines and relevant regulations from the National Medical Commission (NMC).

4. Subscription, Billing, & Refunds

Free Trial: New accounts start with a 30-day free trial. If you do not choose a plan before the trial ends, your account will be paused.
Billing Cycle: Subscriptions are billed on a recurring monthly or annual basis depending on your plan. All pricing is exclusive of GST (18%), which will be added at checkout.
No Refunds: Paid subscription fees are non-refundable after the free trial period ends, as every customer gets a full 30 days to evaluate the system.

5. Medical Disclaimer & Limitation of Liability

CRITICAL NOTICE: Dermicea is a productivity tool and digital EMR template system. It is NOT a diagnostic system and does not provide clinical guidance.

The prescribing doctor is solely and independently responsible for all clinical decisions, patient diagnoses, prescription drugs, dosages, laser parameters, and treatment outcomes.

Dermicea and its owners (Woltbot) shall not be liable for any claims related to medical negligence, malpractice, misdiagnosis, treatment failures, or any indirect, incidental, or consequential damages resulting from the use of the Service.

6. Intellectual Property

All rights, title, and interest in the Service, including the software codebase, database designs, interface layouts, and branding, remain the exclusive property of Woltbot.

All clinic-specific data, patient records, diagnostic notes, and financial reports uploaded by you remain your exclusive intellectual property.

7. Termination & Data Portability

You can cancel your subscription at any time. Upon termination, you have the right to request a full export of your patient files and records in standard format (Excel/CSV).

Dermicea reserves the right to suspend or terminate accounts that violate these Terms, fail to pay subscription dues, or engage in fraudulent activities.

8. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of India (Jaipur / New Delhi).
